Take-Two Interactive has won the dismissal of a lawsuit over claims the NBA 2K series used copyrighted tattoos on its digital athletes without permission.
The copyright breach, raised by Solid Oak Sketches, sought damages of up to $150,000 per infringement. That means, in theory, the total payout for every tattoo used without permission could be somewhere in the billions of dollars.
Stars who Solid Oak Sketches claim to have inked include LeBron James, Kobe Bryant, and a selection of other NBA players.
While U.S. District Judge Laura Taylor Swain in Manhattan has dismissed the case, she says Solid Oak Sketches can still pursue actual damages (money awarded as compensation for loss of profit).
